District Court Judge Robert C. Jones denied

Don Britt & John Gilbert: FELA and the $48
Million Jury Verdict Eric Doi, a Union
Pacific Railroad Co. (UP) employee, was
severely injured in a tragic vehicular
accident, rendering him a C-4 Quadriplegic.
UP denied liability, alleging at the time of
the event Doi was not in the "course & scope"
of their employment and was using the UP
company truck for personal reasons during
off-hours. This case centered on the
definition of "What is the 'course & scope'
of employment" under FELA, The Federal
Employers' Liability Act. The jury, after
weighing all the evidence, believed Eric
Doi's attorneys, Don Britt and John Gilbert
of The Britt Gilbert Law Group. Eric Doi was
awarded over $48 million, what is believed to
be the largest verdict for a single injured
individual in the 100 year history of FELA.
This is the story of how The Britt Gilbert
Law Group sought and got justice for Eric
Doi. Don Britt is a highly distinguished
attorney, who decided to become n lawyer at
an early age, when after being an accident
victim, he became fascinated by the legal
process. He earned both his undergraduate and
law degrees at the University of California
at Berkeley in 1966 and 1969 respectively.
Don spent the first 10 years of his career

Gilbert attended the University of Wyoming,
where he earned a Bachelor of Arts Degree in

exposed to the legal aspects of the F.E.L.A.
when he transferred to the Union Pacific
Claims Department. With his first hand
experience in railroad claim procedures and a
broad understanding of how the F.E.L.A.
applies to railroad employees, he decided to
attended Western State University College of
Law and earned his law degree in 1988. He
left Union Pacific in the fall of 1989 to
pursue a career as a trial attorney.

Racism in America – Bird v. Regents of New
Mexico State University Las Cruces, is The
City of the Crosses, the second largest city
in New Mexico and the home of New Mexico
State University (NSMU), founded in 1888, New
Mexicos only land grant university. New
Mexico State University began as an
agricultural college and now it is a
comprehensive institution dedicated to
teaching, research, and service at the
graduate and undergraduate level. The
university also has an extensive
international student population from
countries in Central America, the Caribbean,
South America, Europe, Asia and the Middle
East. The Total enrollment for NMSU main
campus and branch campuses is 26,391.
Minority enrollment at the main campus is
more than 48 percent (41.4 percent Hispanic,
2.9 percent American Indian, 2.7 percent
African-American and 1.3 percent
Asian-American). Obviously, NMSU and Las
Cruces have a long and proud history of
ethnic traditions; and one would never, ever
think that this university – the only
research-extensive, land-grant, USA-Mexico
border institution classified as Hispanic
serving by the federal government – would
become a battlefield of racial
discrimination, retaliation and wrongful
termination. But it has, because of the
actions and racist attitudes of a very small
group of former NMSU faculty and regents –
a place where five plaintiffs, Drs. Yelena
Bird, Robert Buckingham, John Moraros, Satya
Rao and Freedom Cheteni, received anonymous
hate letters calling them the N-word or
N-lover and warning them to leave NMSU or
else. Other racist comments included threats
to oust these Bird and Moraros from the
university because the academy is not the
place for your kind of people and that few
wetbacks and n*****s have your kind of
education. This blatant discrimination
against four faculty members and one graduate
student has resulted in many major changes at
the University: The university president
resident is gone; the president of the Board
of Regents, too; as well as two other regents
and a former associate dean. Today, The

goes beyond discrimination in the application
of human rights. Every law which offers
unequal protection to men and women is a
violation of the Universal Declaration,
whether or not this law seeks to protect
human rights. More progress has been made for
women, but most women continue to work in
jobs stereotyped as female jobs and women in
nearly all job categories receive less pay
than males in those same job categories.
Women face limits on promotion to high-level
management positions because of conscious and
subconscious sex bias and continue to
experience sexual harassment on the job
despite increased employer awareness of an
employer’s obligation to take preventive

learned of serious eye infections caused by
their ReNu with MoistureLoc contact lens
solution. Approximately 6 months later they
initiated recalls only in Hong Kong and
Malaysia, continuing to sell the product in
the U.S. until April 2006, completely
disregarding the safety of U.S. consumers.
Evidence later showed that they: cut corners
in the design and testing of ReNu; lied to
the FDA to gain their approval; switched the
formulation of ReNu to get it to market
quicker; and hid its February 2006 recall in
Asia from U.S. regulatory agencies. As a
result thousands of people were injured,
including Elizabeth Poole who underwent
painful and extensive surgeries and
treatments, eventually losing her eye. This

Americans On page one of “The Rules of
Golf: The Spirit of the Game" there is a
discussion about a player's responsibility to
abide by these rules. It’s the true spirit
of sportsmanship, stating: "All players shall
conduct themselves in a disciplined manner,
demonstrating courtesy and sportsmanship at
all times, irrespective of how competitive
they may be. This is the spirit of the game
of golf." Golf has been touted for centuries
as a "gentlemen's game," and, rightly so. For
Champion Hall of Famer, Bob Betley, “The
Spirit of the Golf Game” has exemplified
his entire professional career. And,
although Bob got a late start in playing the
game, he made up for it quickly, turning pro
just a couple of years after taking up the
game seriously. With his wife and caddie,
Jane, at his side, he won the Utah Open in
1979 and went on to win state open titles in
Colorado, Arizona, Nevada and Idaho, piling
up a more than 75 tournament victories and
over $1 million in career earnings along the
way. Bob's biggest win as a pro came when he
won the 1993 Bank of Boston Classic on the
Senior PGA Tour. He also finished second in
the Shootout at Jeremy Ranch, losing a
memorable 8-hole, sudden-death playoff to
former U.S. Open champ Orville Moody in the
Utah Senior Tour event. He was a
“gentleman” amongst gentlemen and on top
of his game – but then tragedy struck.
Bob was seriously and permanent injured
when his car was rear-ended by an
underinsured driver. As a result, he hasn't
been able to golf or enjoy one of his other
great talents, painting – primarily
wildlife oils and portraits – since then.
No more golf, no more travel, no more
painting. In an instant, Bob’s livelihood
and way of life ceased to exist. Despite the
trauma and hardship, he and his wife were
determined to soldier on. As hardworking,
responsible, and honest as ever, they thought
they could handle things themselves. They
filed a claim with their own auto insurance
company (a “first-party claim”) and
assumed they’d be treated fairly – just

Story” This is a tragic story of
Government and Corporate Irresponsibility,
that resulted in the clearly preventable
deaths of three innocent Logan, Utah
residents, Jackie Leavey, Age 43, and her 2
children, Victor Age 13, and Abbey Age
12. Everyone in authority at the city, the
State University, the Department of
Transportation, and the local canal company
knew there was a serious problem with the
Logan canal, in Logan, Utah. In the days
preceding the mudslide, officials had visited
the site and had seen the water squirting 10
feet high into the air because it was under
so much pressure in the canal. They all
knew the danger of a mudslide in that
particular area. It had happened before-they
knew it would happen again, soon. Folks in
the affected neighborhood kept calling the
city. Call after call and nobody cared. No
one took action, no one did a thing. Then the
unthinkable occurred. A mudslide of
tremendous proportions dropped on a home,
killing a mother and her two children. It
took days to sift through the mud, trying to
recover their bodies. Folks were somber and
reflective. But then the finger pointing
began. Each department blamed the another for
not taking action. Only it was too late, too
late to save the mother and her children. In
