Bruce D. Fox is a partner and co-founder of Fox and Farley.   <title>Asbestos Illnesses – Alcoa’s Defeat – The Amanda Satterfield</title>

The Tennessee Supreme Court has issued a “huge victory” for workers nationwide, especially for victims of mesothelioma lung cancer and other asbestos-related diseases, in a ruling saying a corporation, Alcoa, “has a full duty to prevent its employees from going home at the end of the workday in clothes that are contaminated with asbestos fibers.” Alcoa, a Fortune 100 company, “knew that the families of such workers could be exposed to the tiny dangerous asbestos fibers that can easily be inhaled if they become airborne.” The company had, and now has, an important duty to set precautions for its employees and prevent asbestos exposure. “ 
The plaintiff, Amanda Satterfield, was a beautiful 25-year-old young lady who died on January 1st, 2005. Amandas family continued her lawsuit, suing Alcoa for $10 million in compensatory damages and $10 million in punitive damages, and settled the case in September 2009. Amanda was exposed to asbestos in the late 1970s when she was just a few days old. Born in a premature birth, Amanda had to spend the first 3 months after her birth at a hospital in Knoxville, Tennessee, during which period her father was employed at Alcoas aluminum plant. Her father was exposed to asbestos on the job, and he then visited his baby daughter in the hospital immediately after work, wearing the same asbestos-contaminated clothes. 
The court was surprised at realizing that Amanda was exposed to asbestos from day one of her life, thanks to her fathers asbestos-contaminated work clothes. Proof presented at the Supreme court included Alcoa knew that the air in its factories contained high amounts of asbestos fibers, and workers in the plant were inhaling these fibers that can easily get clogged up in the lungs and lead to lung scarring or inflammation. In fact, Alcoa conducted tests to determine the amount of asbestos fibers on their employees asbestos-contaminated clothes, and the result was very high. It was proven that Alcoa knew that even a small amount of exposure to asbestos fibers could lead to deadly diseases. 
Using these facts, the Tennessee Supreme Court decided that Under Tennessee law, Alcoa has a duty to prevent foreseeable injury from an unreasonable risk of harm that it had itself created.  The Tennessee Supreme Court, stated that, In light of the magnitude of the potential harm from exposure to asbestos and the means available to prevent or reduce this harm, we see no reason to prevent carpool members, baby sitters, or the domestic help from pursuing negligence claims against an employer should they develop mesothelioma after being repeatedly and regularly in close contact with an employees asbestos-contaminated work clothes over an extended period of time.

       <p>[i]:Medical Malpractice Case: The Emma Mejias Story.&quot;[/i]  Emma Mejias died a horrible and painful death, on her very first Christmas Eve in 2004, at the hands of 25 doctors and nurses, another victim of medical malpractice. All 25 of them systematically and willfully ordered and administered the wrong drugs for her life-threatening condition called SLOS (Smith Lemli Opitz Syndrome). SLOS is a congenital abnormality, which requires treatment strategies on supplying supplemental cholesterol. Emma was given the Wrong Drug, Questran, not once, but 92 times – yes, 92 times in one month. All of the doctors and nurses knew better.  They were trained to know better. They were some of the world’s leading authorities at the LSU Health Sciences Center in New Orleans. And her doctors had the unmitigated gall to blame Emma’s death on the new resident doctors, rather than take responsibility themselves. Emma remained hospitalized at various hospitals from the date she was born to the day she died, because of the outrageous medical malpractice perpetrated on her by 25 so-called health care professionals, none of whom cared enough to give her the potentially life-saving medical treatment she desperately needed. She suffered enormous physical pain and suffering prior to her death. It all began one dark and rainy night on November 15, 2005, on Highway P in the little town of Richmond, Wisconsin, when Michael Turner, a 50-year-old, very drunk driver with a blood alcohol content of double the legal limit, swerved across the clearly marked double yellow centerline on Highway P, in his big Ford pickup truck, and slammed directly head-on into 17-year-old Ashley Kubicz’s little car . . . with catastrophic results! Trapping her legs in excruciating pain in the car, severing the artery in her left leg (which deprived it of the life-sustaining blood she desperately needed), Ashley clung on courageously while the medics rushed her to hospital.  Her injuries were so severe that the doctors had to amputate her leg halfway from her hip to her knee, which effectively ended her dreams of being a softball star. Turner was hauled off to jail, and one more tragic “alcohol-related” drunk driver accident was added to the approximately 630,000 people injured in alcohol-related crashes every year. That’s an average of one person injured approximately every minute of every day of every year.

       <p>Media Deaths – The Jenny Jones TV Show Case

The Jenny Jones Show was a popular talk show broadcast for 12 years, from September 1991 until the winter of 2003, one of the many media exploiting talk shows supposedly featuring real people with compelling personal stories. On an episode called &quot;Same-Sex Secret Crushes&quot; taped on March 6, 1995, a gay man named Scott Amedure confessed his love for his friend, Jonathan Schmitz. While on the show, Schmitz reacted with laughter, but he became disturbed by the incident later. He had a history of mental illness and alcohol/drug abuse. Three days after the show&#039;s taping, Schmitz killed Amedure, and was later convicted of second-degree murder and received a sentence of 25–50 years in prison. The episode was never aired. According to the testimony at the murder trial, three days after the taping, Amedure left a &quot;suggestive&quot; note at Schmitz&#039;s house. After finding the note, Schmitz withdrew money from the bank, purchased a shotgun, and then went to Amedure&#039;s mobile home. There, he questioned Amedure about the note, to which Amedure just smiled. Schmitz then returned to his car, got his gun and returned to Amedure&#039;s trailer. He then shot Amedure twice in the chest, killing him. After killing Amedure, Schmitz left the residence, called 911, and confessed to the killing. In 1999, Amedure&#039;s family then retained Geoffrey Fieger and sued the producers of The Jenny Jones Show, Telepictures, and Warner Brothers for the ambush tactics and negligent role that led to Amedure&#039;s death. Amedure&#039;s family won the initial ruling, and the show was ordered to pay them $25 million, after a jury found that the Jenny Jones Show was both irresponsible and negligent, contending that the show intentionally created an explosive situation without due concern for the possible consequences. The judgment was later overturned by the Michigan Court of Appeals in a 2 to 1 decision. The Michigan Supreme Court declined to hear the case. The case is now studied in law school tort classes because of the legal significance of saying the show&#039;s producers were not responsible for guests&#039; safety after they had left the studio.

       <p>AIR CRASH - ALASKA AIRLINES ; THE FAA WHISTLEBLOWER. Alaska Airlines Flight 261, a MD-83 aircraft, experienced a fatal accident on January 31, 2000, in the Pacific Ocean, about 2.7 miles north of Anacapa Island, California. Two hours into the flight, the pilots realized that the horizontal stabilizer was jammed. The two pilots, three cabin crewmembers, and 83 passengers on board were killed—the highest death toll of any aviation accident involving a MD-83 ever, and the aircraft was destroyed. This accident and other unsafe airline situations could have been easily avoided, if the FAA and Alaska Airlines had listened to Mary Diefenderfer, a former FAA Principal Operations Inspector, who from 1993 to 1997 oversaw the team of inspectors who regulated Alaska Airlines’ operations/functions. In August 1993, Mary discovered that the Vice President of Flight Operations at Alaska Airlines had falsified his own pilot training records. Despite the accuracy of her reports, soon after her team exposed the violation by Alaska Airlines, FAA management reassigned her to another office and removed her from oversight of Alaska Airlines operations. The agency denied her grievances, revoked her pilot’s license, revoked the Leave Without Pay that she had requested due to severe emotional distress, declared her AWOL, and issued a proposed suspension – all in the space of several weeks. These actions forced her involuntary resignation in November 1999.        <p>The Good Samaritan – Jimmy Dunne’s Story

On March 13, 2004, at 4:30 PM, Jimmy Dunne, a Vietnam Veteran, retired railroad conductor and American Legion Commander, and his wife were returning from a birthday party, when they witnessed and stopped to help the victims of a three-car crash in the small town of Port Jefferson Station, New York. Jimmy offered help because he was a Good Samaritan, and he knew CPR. While Jimmy gave his statement to police officers, a brand new Subaru driven by Lisa Lloyd crashed into the police barricades and slammed into Jimmy. Lisa kept going, with Jimmy’s head smashed into the windshield, until the fire chief ran alongside her car, dove through the window and threw the car into park. Jimmy was catapulted 30 feet into the air, landing on his head and changing his life forever in that split moment. Jimmy’s head was fractured in two places, and he suffered a brain hemorrhage. He plunged into a coma for a month and required brain surgery to treat his injuries. He now requires round-the-clock nursing care due to his injuries. Lisa Lloyd later pleaded guilty to second-degree assault while driving a car while impaired by drugs. The Terminix truck had extremely worn out tires, one with 87,000 miles on it, and was sent out in inclement weather despite two employee requests for new tires. DaimlerChrysler/nOn November 11, 2004, a Nashville, Tennessee, jury returned a verdict of $105.5 million against the DaimlerChrysler Corporation, finding the seatbacks in Chrysler minivans were unsafe, defective and unreasonably dangerous. The case involved injuries to and the death of an 8-month-old child, Joshua Flax, in the rear-end collision which occurred in Davidson County, Tennessee, on June 30, 2001. Joshua was fatally injured when his grandfather’s 1998 Dodge Caravan minivan was hit in the rear. The front passenger’s seatback collapsed backward, and the passenger’s head hit Joshua’s forehead, fracturing his skull.
